Fisher Maritime has a proven history of timely development of accurate analyses and assessments of marine construction project dispute issues. We have assisted shipowners, shipyards, and vendors to resolve disputes in a myriad of ways, including:
- Evaluation of available alternative dispute resolution mechanisms.
- Participating in negotiations, which has often been a catalyst leading to a resolution.
- Helping our clients achieve acceptable resolution in formal mediation proceedings
- Providing expert services and testimony in court and arbitration proceedings.
How We Can Help
In one particular previous case, a shipbuilder was in the process of performing major mid-life extension work on a government vessel when it was discovered that the vessel contained enormous quantities of lead-based paint, the remediation of which was not included in the contractual work scope. The government agreed to change orders to accomplish the specific remediation work, but disputed the shipyard claim that such additional change work fostered indirect effects such as local and cumulative disruption, acceleration and time-displaced work, as well as delay costs such as unrecovered overhead, additional project management, additional equipment rental costs and other additional support services costs. Fisher Maritime developed the entitlement arguments and quantification of those indirect and delay costs for the project at issue, which efforts led to the negotiation of an appropriate resolution.
